Are you planning to sell a property in Menorca? Here’s how the sale is taxed under Spanish Personal Income Tax

Before putting your property on the market, knowing its market value is important. Knowing how much you can actually receive after tax, is just as important.

IMPORTANT: this article applies exclusively to property owners who are tax residents in Spain. If you own a property in Menorca but are not a tax resident in Spain, the sale is subject to different tax rules and must be assessed separately.

Selling a property in Menorca can generate a significant capital gain, especially if the property was purchased many years ago. But there is one question every owner should ask before selling: how much Spanish Personal Income Tax (IRPF) will I have to pay when I sell my property?

How is the sale of a property taxed under Spanish Personal Income Tax (IRPF)?

When a tax resident in Spain sells a property, the difference between the disposal value and the acquisition value may result in a capital gain or loss that must be declared for IRPF purposes.

There is an important point to bear in mind: the capital gain is not simply the sale price minus the price you paid for the property.

Certain expenses and taxes paid when purchasing the property may be added to the acquisition value, together with the cost of investments and improvements made. Certain expenses and taxes directly associated with the sale and paid by the seller may also be deducted from the disposal value. If the property has been rented out, tax-deductible depreciation may also affect the calculation.

For this reason, before selling it is advisable to gather the title deeds, invoices and other documentation relating to the property.

How much IRPF is payable on the capital gain?

The capital gain is included in the savings tax base and taxed progressively:

19% up to €6,000

21% from €6,000 to €50,000

23% from €50,000 to €200,000

27% from €200,000 to €300,000

30% above €300,000

This does not mean that, if the gain exceeds €300,000, the entire amount is taxed at 30%: each band is taxed at its corresponding rate.

Are there cases in which no IRPF is payable?

Yes. One of the main exemptions concerns the main residence.

If the amount obtained is reinvested in another main residence and the applicable requirements are met, the gain may be fully or partially exempt. The reinvestment must take place within the statutory period of two years before or after the transfer.

In addition, people over the age of 65 may be exempt from tax on the capital gain obtained from the sale of their main residence, provided that the legal requirements are met.
