What documents does a homeowner need to sell their house in Menorca?

Selling a home in Menorca is a process that goes far beyond showing the house to potential buyers. One of the most important aspects—and one that often raises the most questions—is the documentation needed to successfully close the transaction.

  1. Title Deed

This document proves that you are the legal owner of the property. It's also known as the title deed or public deed of sale. It's essential for formalizing any sale before a notary.

SOM Tip: If you can't find your deed, you can request a copy from the notary where the sale was signed or from the corresponding Property Registry.

  1. Updated Simple Note from the Property Registry

This document includes the property's registry information (ownership, encumbrances, mortgages, easements, etc.). It is essential to provide transparency in the transaction and is usually requested at the beginning of the process.

  1. Energy Efficiency Certificate (CEE)

Since 2013, it has been mandatory to have an Energy Efficiency Certificate (CEE) to sell any property. This document provides information on the home's energy consumption and CO₂ emissions.

It must be issued by an authorized technician. At SOM Menorca, we have collaborators who can process it quickly and cost-effectively.

  1. Property Tax (IBI) Receipts

Prove that the tax is paid up to date. You will need paid IBI receipts for the last three years.

SOM Tip: Make sure you keep proof of payment of the current year's IBI.

  1. Certificate of current community payments

If your home belongs to a homeowners' association, you will need a certificate proving that there are no outstanding debts with the association. This document is issued by the property manager.

  1. Certificate of Occupancy

In the Balearic Islands, the certificate of occupancy is a mandatory document for selling a home. It guarantees that the property meets the minimum habitability conditions.

SOM Recommendation: It is valid for 10 years. To date, notaries do not require this document for the deed of sale, but it is recommended to have it.

 

  1. Additional Documentation (as applicable)

Depending on the type of property or its legal status, additional information may be required:

  • Floor plan of the property (optional)
  • Latest utility bills (water, electricity, gas)
  • Bylaws and latest Homeowners' Association Certificate
  • Certificates of urban planning debts in the case of land or building plots
  • Proof of renovations or extensions
  • Cadastral reference
